Virtual Event Terms and Conditions of Participation

These are the terms and conditions (the “Agreement”) governing your participation in any Whisky Auctioneer owned and operated virtual event, meeting, session, tasting or masterclass (the “Virtual Event”). By registering for the Virtual Event you agree to these terms, which form a binding legal contract between the Virtual Event owner and host, Whisky Auctioneer (“Whisky Auctioneer” or “Owner and Organiser”) and the registered participant (“you” or “Participant”). If you are registering on behalf of another individual, it is your responsibility to ensure the person participating is aware of these terms and accepts them. By completing the registration on behalf of another individual you are warranting that you have made the Participant aware of these terms and that they have accepted these terms.

These terms and conditions complement rather than replace Whisky Auctioneer's Terms and Conditions and Privacy Policy

 

1. Participant Requirements

1.1 Access. Your payment and booking (managed by the third party booking platform) entitles you to access to the Virtual Event for which you have registered. Any and all other costs associated with your attendance shall be borne solely by you, and Whisky Auctioneer shall have no liability for such costs.

1.2 Use of Likeness. By participating in the Virtual Event you acknowledge and agree to grant Whisky Auctioneer the right to record, film, live stream, photograph, or capture your likeness in any media now available or hereafter developed and to distribute, broadcast, use, or otherwise globally to disseminate, in perpetuity, such media without any further approval from you or any payment to you. This grant to Whisky Auctioneer includes, but is not limited to, the right to edit such media, the right to use the media alone or together with other information, and the right to allow others to use or disseminate the media. 

1.3 Virtual Event Content. You acknowledge and agree that Whisky Auctioneer, in its sole discretion, reserves the right to change any and all aspects of the Virtual Event, including but not limited to, the Virtual Event name, themes, content, program, speakers, performers, hosts, moderators, venue, and time. Only if clearly advertised as such will Virtual Event content recorded by Whisky Auctioneer be accessible to paid Participants for a limited time following the event and this may not be the content in full, but an edited version.

1.4 Age Restriction. Please note that you must be over the age of 18 years old (or the legal age within your own country of residence) to register and sell and/or buy Goods via the Website.  We reserve the right to ask buyers and sellers for identification to prevent fraud, underage purchases and/or any other legal or legitimate purpose.  All deliveries must be signed for by a person of legal drinking age in your country of residence and we reserve the right to ask for ID from the person receiving the delivery.

 

2. Prohibited Conduct

2.1 Limitations on Use. By registering for a Whisky Auctioneer Virtual Event you agree not to sell, trade, transfer or share your access link and/or code, unless such transfer is granted by the Organiser. If Whisky Auctioneer determines that you have violated this policy, Whisky Auctioneer may cancel your access, retain any payments made by you, report you to law enforcement authorities, and ban you from future Virtual Events.

2.2 Disruptive Conduct. You acknowledge and agree that Whisky Auctioneer reserves the right to remove you from the Virtual Event if Whisky Auctioneer, in its sole discretion, determines that your participation or behaviour create a disruption or hinder the Virtual Event or the enjoyment of the Virtual Event content by other attendees.

2.3 Recording, Live Streaming, and Videotaping. Participants may not record or broadcast audio or video of sessions at Whisky Auctioneer Virtual Events.

2.4 Unethical/Non-Compliant Business Practices. Whisky Auctioneer reserves the right to deny participation to anyone who engages in or is reputed to engage in unethical or non-compliant business practices.

2.5 In addition to the requirements and prohibitions set forth in this Section 2, Whisky Auctioneer may also exclude any prospective participant from registering for or participating in any Virtual Event, in Whisky Auctioneer’s sole discretion.

 

3. Fees and Registration

3.1 Payment. The payment of the applicable fee for the Virtual Event is due at the time of booking and will be handled via the third party booking platform. If such payment is insufficient or declined for any reason Whisky Auctioneer may refuse to allow you to access the Virtual Event and shall have no liability in that regard.

3.2 Taxes. The fees may be subject to sales tax, value added tax, or other taxes and duties which, if applicable, will be charged to you in addition to the fees.

 

4. Cancellation and Quality Assurance

4.1 Whisky Auctioneer strives to provide you with the most productive, informative and engaging experience possible. If after attending a Virtual Event you feel there is some way we can improve, please provide us with your comments on the feedback form which will be sent post-event. Should you feel dissatisfied with your experience and wish to request a credit or refund, please submit it in writing no later than 10 business days after the end of the Virtual Event to info@whiskyauctioneer.com
We will evaluate individual complaints in a context of collective comments from the Virtual Event. If a guest speaker is promoted as part of the Virtual Event, these are confirmed in great advance of the Virtual Event, some speaker changes or topic changes may occur in the program. Whisky Auctioneer is not responsible for speaker changes, but will work to ensure a comparable speaker is located to participate in the program.

4.2 Cancellations are subject to the entire Virtual Event fee. All sales are final. No payments will be refunded or refundable. Please note that if you do not cancel and do not access the Virtual Event, you are still responsible for payment. In no event shall Whisky Auctioneer be obligated to refund all or a portion of the registration fee.

4.3 If Whisky Auctioneer is prevented from carrying out its obligations as it pertains to the Virtual Event you registered for as a result of any cause beyond its control, or such Virtual Event cannot be Virtually conducted because of technical difficulties or Force Majeure, Whisky Auctioneer will determine at its discretion whether to reschedule or refund any amounts for such virtual tasting.

 

5. Virtual Event Booking Confirmation

5.1 Once you have completed your booking, you will receive your registration confirmation by email from the third party booking platform. Please ensure that your valid email is entered correctly on at the time of booking. Be sure to check your junk email box too in case any of your Virtual Event email(s) are caught by spam filters.

5.2 You will receive essential information for registered attendees electronically at the email address and mailing address that are provided at the time of booking.

5.3 In addition, you will also be added to the Virtual Event participant list for notifications of future Virtual Events.

5.4 If you would like to opt-out of any of these benefits, a link is provided in each email to provide the ability to opt-out.

 

6. Virtual Event Products and Services

6.1 Where Whisky Auctioneer decides to hold such an event, they will notify members of such tastings through its website, email or social media. Whisky Auctioneer will determine if and where charges for virtual tastings will apply. This charge will include appropriate post and packing costs to enable the Virtual Event. 

6.2 Where sample tasting presentations (Kits) are included as part of the virtual tasting event, Whisky Auctioneer will endeavour to the best of its ability to dispatch kits well before the relevant event to allow for timely arrival. Whisky Auctioneer accepts no responsibility for delays in postal or courier services beyond its control and the risk in the presentation kits will transfer to the carrier on receipt by the carrier of the kits from us, following which point we exclude all liability for any loss or damage to the kits thereafter including during transit to the buyer’s premises.

6.3 By default, Whisky Auctioneer will not offer any insurance, indemnity, registered post or courier options for dispatching any presentation kits. However, should a circumstance arise where the items shipped warrant insurance and/or more secure shipping options, the organiser will decide at its discretion how best to secure and safeguard such items.

6.4 Shipping and Delivery. The costs of delivery will be as displayed to you in our promotional communications and the booking platform.. Please note that we may be unable to ship or deliver to all locations for certain events, this will be clearly communicated on the promotional communications and booking platform when known. If you have any queries regarding shipping please contact us before purchasing a ticket to confirm we can deliver to your location. Whisky Auctioneer will not bear liability for any local taxes, charges, duties, tariffs, penalties, or additional fees of any nature whatsoever. In addition, Whisky Auctioneer will not bear liability for products which may be confiscated, delayed, inspected, damaged or destroyed by national authorities including customs authorities, postal services or similar. Attendees wholly accept liability for any such charges and have no recourse to Whisky Auctioneer for any loss or damages.

6.5 Kits may vary slightly from their pictures. The images of the products on our website are for illustrative purposes only. Although we have made every effort to display the colours accurately, we cannot guarantee that a device's display of the colours accurately reflects the colour of the products. 

6.6 Kits packaging may vary. The packaging of the kits may vary from that shown in images on the third party booking platform. 

6.7 Significant changes to the Kits. Whilst it is unlikely, we may make changes to these terms or the product, but if we do so we will notify you and you may then contact us to end the contract before the changes take effect and receive a refund for any products paid for but not received.

6.8 When we will provide the products or services. We will contact you with an estimated delivery date for the Kits, which will be within 30 days after the day on which we accept your order. The Virtual Event will be provided on the date set out in the order. 

6.9 Where Whisky Auctioneer provides a Kit as part of a virtual tasting and such presentation is damaged, destroyed or lost in transit, we will not issue any replacement of lost or damaged presentations. No cash alternatives will be offered.

Members who register for any virtual tasting event are agreeing to be bound by these terms and conditions.
